Ing. As a seller, Roman Schmock undertakes to respect and protect your privacy. The seller is committed to protecting your personal data and is acting in accordance with the law.

The seller is committed to the protection and security of your personal data. We use a number of different security technologies and procedures to protect your personal information from unauthorized access, use or disclosure. If you provide us with your personal information when ordering products or services, you can be sure that we will only use it to ensure and maintain contact between you and us. The seller will not sell or in any way rent your personal data to anyone else. Unless I have your consent, or unless otherwise required by law, I will not share your personal data that you provide to us online.

A. What personal data do we process?

When you use our services, we collect various types of data, such as your username and password, your contacts, and other settings. I track which products you view on our website and from which device. If you shop with us or create an account, we also work with your first and last name, your orders and the information you set up in your account.

We process the following personal data:

  • identification data , which in particular means first and last name, username and password if you are purchasing in installments, ID number and VAT number if you are an entrepreneur;

  • contact information , which means personal information that allows us to contact you, in particular email address, telephone number, delivery address, billing address and your contact on social networks;

  • your settings , which means data in your account, especially saved addresses and profiles, loyalty program memberships, shopping lists, watched products, your evaluations of products and services and completed questionnaires;

  • ** data about your orders**, which are in particular data about the goods and services you have ordered, the method of delivery and payment, including the payment account number and data about complaints;

  • data about your behavior on the website , including when you view it through our mobile application, in particular the goods and services you view, the links you click on, the way you move around our website and scroll the screen, as well as data about the device from which you you browse our website, such as the IP address and the location derived from it, device identification, its technical parameters such as the operating system and its version, screen resolution, the browser used and its version, as well as data obtained from cookies and similar technologies for device identification;

B. Why do we process personal data and what authorizes us to do so?

We process your personal data in different situations for different purposes. If you use our website, on which we also use cookies, we use your data mainly to monitor traffic and improve our services. If you register with us, we use your information to manage your accounts and provide related features. If you make a purchase from us, we use your information to process your order, protect our legal claims and fulfill our legal obligations. We are authorized to process personal data either for the preparation or performance of a contract with you, compliance with legal obligations, our legitimate interests or your consent.

What kind of processing we can carry out without your consent depends on the purpose of the respective processing and in what position you are in relation to us - whether you are just a visitor to our website or you register or make a purchase with us. We may also process your data if you are the recipient of goods or services ordered from us or if you communicate with us.

Use of cookies and other technologies, transfer of data to advertising and social networks

If you visit our website, we store and then read small files such as cookies on your device. If you visit the jimot.cz website, we process data about your behavior on the website based on our legitimate interest (i.e. without your consent) in order to:

  • obtaining information on the basis of which we can improve the website for you in the future to make your shopping experience even better; our legitimate interest here is to improve our services to you;

  • creating statistics and reports, in particular monitoring the traffic of our website, its individual pages and measuring the effectiveness of advertising; our legitimate interest here is to measure the effectiveness of our website

  • testing new features and applications before deployment, in particular to avoid problems with the functionality of these innovations in real life that could impair your shopping experience with us; our legitimate interest here is the smooth functionality of our services for you;

  • preventing attacks on our website and endangering its functionality and the security of your data; our legitimate interest here is the trouble-free functionality of our services for you and the security of your data.

We do not only obtain data about your behavior on the website from cookies. We also supplement them with data:

  • The IP address of your device (the address of your device that you use to communicate with other devices on the Internet);

  • your device's operating system, version and language settings;

  • the browser you use on your device, its version and language settings;

  • the website address (URL address) from which you come to our website.

Processing based on contract performance

If you create an account on the jimot.cz website, we process your identification and contact data, your settings and data about your orders (if you later buy from us), based on the performance of a contract with you (without your consent), in order to maintain your user account . The contract on which our processing is based is created by the creation of your account. For this purpose, we use personal data for the duration of your account, which you can delete at any time.

B.3 If you buy from us

In order to make a purchase from us, you must visit our website, therefore the processing described in the section If you visit our website applies to you. If you make a purchase from us, we also carry out the following processing:

Processing based on contract performance

If you make a purchase from us as a natural person, we process your personal data for the purpose of processing your order, your identification and contact data and data about your orders. If you have a user account with us, we may also use your settings for this purpose.

If you purchase from us as a representative of a legal entity, we process the same data for the same purpose based on our legitimate interest in concluding and fulfilling a contract with the person you represent.

The fact that we use this data for the purpose of processing your order means that we use it in particular:

  • so that you can complete your order on the website, for example, so that the goods placed in the basket or the data from the order in progress are not deleted;

  • to communicate with you about your order, such as sending you order confirmation or notifying you that goods have been shipped;

  • for the needs of delivering goods; in this context, we may also transfer your data to our shipping partners, exclusively for the purpose of delivering these goods; as described in Who processes your personal data and to whom do we share it?;

For this purpose, we use personal data for the time necessary to process your order, or settlement of a contractual claim, such as a complaint.

Processing based on the fulfillment of legal obligations

We also have to fulfill certain statutory obligations. If we process your personal data for this very reason, we do not need to obtain your consent for such processing. On this legal basis, we process your identification and contact data, order data, in order to comply with the following laws in particular:

For these purposes, we use personal data for the necessary period from the issuance of the last document for your order.

B.4 If you are the recipient of goods or services ordered from us

If you are the recipient of goods or services ordered from us, we process your identification and contact data:

  • based on our legitimate interest for the purpose of preparing, concluding and fulfilling the contract with our customer. Fulfilling this contract is also our legitimate interest;

  • based on our legitimate interest to obtain information on the basis of which we can improve our services in the future or information to create our internal statistics and reports; our legitimate interest here is to improve our services to our customers;

  • for the purpose of protecting legal claims and our internal records and controls; our legitimate interests here are the protection of legal claims and control of the proper provision of our services.

For the preparation, conclusion and fulfillment of the contract with our customer, we use personal data for the time necessary to process the order. After the expiration of this period, we will continue to retain the data based on our legitimate interest for the purpose of protecting legal claims and our internal records and control, for the duration of the limitation period of 3 years and one year after its expiration with regard to claims made at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after its termination. Our legitimate interests here are the protection of legal claims and the control of the proper provision of our services.

B.5 If you communicate with us through different channels:

If you communicate with us through various channels, especially through email, we will process your identification and contact data and records of the communication that took place based on our legitimate interest (ie without your consent) for the purpose of:

  • processing your requests; if you have purchased from us and your request relates to an order, we can implement this processing based on the performance of a contract with you;

  • records of your requests so that we can check that we fulfill them properly and on time; -

  • proving that we have accepted and processed your request, e.g. when you order some goods from us in this way or make a claim;

  • their analysis to improve the quality of our services.

For these purposes, we keep personal data for the necessary time. If you place an order with us using one of the channels, we may retain the data for the protection of legal claims for the duration of the limitation period of 3 years and one year after its expiry with regard to claims made at the end of the limitation period. C. Who processes your personal data and to whom do we pass it on?

In most cases, we process your data for our own purposes as its controller. In this case, we transfer your data to our partners to ensure payment, transport and other details of your order. We also transfer the data to our processors, who process it according to our instructions. All mentioned personal data are processed by us as the administrator. This means that we determine the above-defined purposes for which we collect your personal data, determine the means of processing and are responsible for their proper execution.

We may also transfer your personal data to other entities that are in the role of administrator, namely:

  • in connection with the processing of your order to our partners who participate in this processing, as stated in the section If you buy from us, specifically:

  • to partners operating payment systems for the purposes of ensuring payment, companies are provided through the payment gateway of ComGate Payments, as and PayPal (Europe) S.à rl et Cie,

  • transport partners, in particular the companies PPL sro, ID: 25194798, Uloženka, sro, ID: 24299162, if they deliver your order to you;

For the processing of personal data, we also use the services of other processors who process personal data only according to our instructions and for the purposes described in the section Why we process personal data and what authorizes us to do so. Such processors are:

  • satisfaction survey service provider Verified by customers and intermediary of our sales, the company Heureka Shopping s.r.o., ID number: 023 87 727;

D. From what sources do we obtain personal data?

We usually obtain personal data directly from you through our website or when communicating with you. We may also receive some additional data from our partners, e.g. banks or shipping companies.

In most cases, we process personal data that you provide to us as part of ordering goods or services, creating and using an account. We also collect personal data directly from you by monitoring your behavior on our website and when you read messages.

If you make a purchase from us, we may receive additional data about your orders from banks, our partners operating payment systems, transport partners, for example information about your account number, successful payment, or delivery and receipt of goods in connection with the performance of the concluded purchase contract.

E. Transfer of data outside the EU

In some cases, we may also transfer your personal data to countries that are not part of the European Economic Area.

As part of the transfer of data to our processors, listed in the section Who processes your personal data and to whom do we transfer it? we may also transfer your data to third countries outside the European Economic Area, which do not ensure an adequate level of personal data protection. We will only carry out any such transfer if the relevant processor undertakes to comply with the standard contractual clauses issued by the European Commission and available at this address.

F. What rights do you have when processing personal data?

You have a number of rights in relation to your personal data. This is the right of access, correction, erasure, restriction of processing, portability, objection and complaint.

Just as we have rights and obligations when processing your personal data, you also have certain rights when processing your personal data. These rights include:

  • Right of access

Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we pass it on, who processes it outside of us and what other rights you have related to the processing of your personal data. You can find out all this in this document "Customer privacy protection". However, if you are not sure which personal data we are processing about you, you can ask us to confirm whether or not personal data relating to you is being processed by us and, if so, you have the right to access that personal data . As part of the right of access, you can ask us for a copy of the processed personal data, whereby we will provide you with the first copy free of charge and additional copies with a fee.

  • Right to rectification

To err is human. If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or supplemented without undue delay.

  • Right to erasure

In some cases, you have the right to have your personal data deleted. We will delete your personal data without undue delay if any of the following reasons are met:

-we no longer need your personal data for the purposes for which we processed them;

  • you revoke your consent to the processing of personal data, in which case it is data for which your consent is necessary for processing and at the same time we have no other reason why we need to continue processing this data;

  • you exercise your right to object to processing (see Right to object to processing below) of personal data that we process on the basis of our legitimate interests and we find that we no longer have such legitimate interests that would justify such processing, or

  • you believe that the processing of personal data carried out by us is no longer in accordance with generally binding regulations.

But please keep in mind that even if it's one of these reasons, it doesn't mean we'll delete all your personal data right away. This right does not apply if the processing of your personal data is still necessary for the fulfillment of our legal obligation or the determination, exercise or defense of our legal claims (see the section Why do we process personal data and what authorizes us to do so?).

  • Right to portability

You have the right to receive from us all your personal data that you yourself have provided to us and which we process based on your consent (see section If you give us your consent) and on the basis of the performance of the contract. We will provide you with your personal data in a structured, commonly used and machine-readable format. In order to be able to easily transfer the data at your request, it can only be data that we process automatically in our electronic databases.

  • The right to object to processing

You have the right to object to the processing of personal data based on our legitimate interest.

  • The right to file a complaint

Exercising your rights in the above manner does not in any way affect your right to file a complaint with the relevant supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unlawfully or in violation of generally binding legal regulations. You can file a complaint against our processing of personal data with the Office for Personal Data Protection, located at the address Pplk. Sochora 27, 170 00 Prague 7.

G. How can individual rights be exercised?

The fastest way to apply and request the exercise of the right is by email. We will process your request without unnecessary delay, but within one month at the most. In exceptional cases, especially due to the complexity of your request, we are entitled to extend this period by another two months. Of course, we will inform you about such a possible extension and its justification.
