The Seller is committed to protecting and securing your personal information. We use a variety of security technologies and procedures to protect your personal information from unauthorized access, use, or disclosure. If you provide us with your personal information when ordering products or services, you can be assured that we will use it only to ensure and maintain contact between you and us. The Seller will not sell or in any way rent your personal information to anyone else. A. What personal data do we process?

If you make a purchase or create an account with us, we also process your first and last name, your orders and the data you set in your account.

We process the following personal data:

  • identification data , which means in particular your name and surname, username and password if you are purchasing in installments, company ID and VAT number if you are an entrepreneur;
  • contact information , which means personal data that allows us to contact you, in particular your email address, telephone number, delivery address, billing address and your contact information on social networks;
  • your settings , which means the data in your account, in particular saved addresses and profiles, loyalty program memberships, shopping lists, watched products, your product and service ratings and completed questionnaires;
  • ** data about your orders**, which is mainly data about the goods and services you ordered, the method of delivery and payment, including the payment account number and data about complaints;
  • data about your behavior on the website , including when you view it via our mobile application, in particular the goods and services you view, the links you click on, the way you move around our website and scroll the screen, as well as data about the device from which you view our website, such as the IP address and the location derived from it, device identification, its technical parameters such as the operating system and its version, screen resolution, the browser used and its version, as well as data obtained from cookies and similar technologies for device identification;

B. Why do we process personal data and what authorizes us to do so?

We process your personal data in different situations for different purposes. If you use our website, where we also use cookies, we use your data in particular to track traffic and improve our services. If you register with us, we use your data to manage your account and provide related functions. If you make a purchase from us, we use your data to process your order, protect our legal claims and comply with our legal obligations. We are entitled to process personal data either to prepare or perform a contract with you, to comply with legal obligations, our legitimate interests or your consent.

What processing we can carry out without your consent depends on the purpose of the processing and your position towards us – whether you are just a visitor to our website, or you register or make a purchase with us. We may also process your data if you are the recipient of goods or services ordered from us or if you communicate with us.

We do not only obtain data about your behavior on the website from cookies. We also supplement it with data from:

Processing based on the performance of a contract

If you create an account on the jimot.cz website, we process your identification and contact details, your settings and data about your orders (if you later purchase from us), based on the performance of a contract with you (without your consent), in order to be able to manage your user account. The contract on which our processing is based is created by the creation of your account. For this purpose, we use personal data for the duration of the existence of your account, which you can delete at any time.

In order to make a purchase from us, you must visit our website, so the processing described in the section If you visit our website applies to you. In addition, if you make a purchase from us, we carry out the following processing:

Processing based on the performance of a contract

If you purchase from us as an individual, we process your personal data for the purpose of processing your order, including your identification and contact details and details about your orders. If you have a user account with us, we may also use your settings for this purpose.

If you purchase from us as a representative of a legal entity, we process the same data for the same purpose based on our legitimate interest in concluding and fulfilling a contract with the person you represent.

The fact that we use this data for the purpose of processing your order means that we will use it in particular:

  • so that you can complete your order on the website, for example, so that the goods added to your cart or data from an order in progress are not deleted;
  • to communicate with you about your order, for example to send you a confirmation or notify you when your goods have been shipped;
  • for the purposes of delivering goods; in this context, we may also transfer your data to our transport partners, exclusively for the purposes of delivering these goods; as described in the section Who processes your personal data and to whom do we transfer it?;

For this purpose, we use personal data for the period necessary to process your order or to process a contractual request, such as a complaint.

Processing based on compliance with legal obligations

We also have certain legal obligations. If we process your personal data for this reason, we do not need to obtain your consent for such processing. On this legal basis, we process your identification and contact details, order details, in particular to comply with the following laws:

B.4 If you are the recipient of goods or services ordered from us

If you are the recipient of goods or services ordered from us, we process your identification and contact data:

  • based on our legitimate interest in preparing, entering into and performing a contract with our customer. The performance of this contract is also in our legitimate interest;
  • based on our legitimate interest in obtaining information that will enable us to improve our services in the future or information to create our internal statistics and reports; our legitimate interest here is to improve our services for our customers;
  • for the purpose of protecting legal claims and our internal records and controls; our legitimate interests here are the protection of legal claims and the control of the proper provision of our services.

For the preparation, conclusion and performance of the contract with our customer, we use personal data for the period necessary to process the order. After this period, we will continue to retain the data on the basis of our legitimate interest for the purpose of protecting legal claims and our internal records and controls, for the duration of the limitation period of 3 years and one year after its expiration with regard to claims asserted at the end of the limitation period. In the event of the initiation of judicial, administrative or other proceedings, we process your personal data to the extent necessary for the entire duration of such proceedings and the remaining part of the limitation period after their termination. Our legitimate interests here are the protection of legal claims and the control of the proper provision of our services.

If you communicate with us through various channels, especially via email, we will process your identification and contact data and records of communication based on our legitimate interest (i.e. without your consent) for the purpose of:

  • processing your requests; if you have made a purchase from us and your request relates to an order, we may carry out this processing on the basis of the performance of a contract with you;
  • recording your requests so that we can check that we are fulfilling them properly and on time; -
  • proving that we have received and processed your request, e.g. when you order goods from us or make a complaint in this way;
  • their analysis to improve the quality of our services.

For these purposes, we retain personal data for the necessary period. If you place an order with us through one of the channels, we may retain the data for the protection of legal claims for the duration of the limitation period of 3 years and one year after its expiration with regard to claims asserted at the end of the limitation period. C. Who processes your personal data and to whom do we transfer it?

In most cases, we process your data for our own purposes as their controller. In such cases, we pass your data on to our partners to ensure payment, shipping and other details of your order. We also pass on the data to our processors, who process it according to our instructions. We process all of the aforementioned personal data as the controller. This means that we determine the purposes for which we collect your personal data, determine the means of processing and are responsible for their proper execution.

We may also transfer your personal data to other entities that act as controllers, namely:

  • in connection with the processing of your order to our partners who participate in this processing, as stated in the If you buy from us section, specifically:
  • to partners operating payment systems for the purposes of securing payments, the company is provided through the payment gateway of ComGate Payments, as and PayPal (Europe) S.à rl et Cie,
  • to shipping partners, in particular PPL sro, Company ID: 25194798, Uloženka, sro, Company ID: 24299162, if they deliver your order to you;

We also use the services of other processors to process personal data, who process personal data only according to our instructions and for the purposes described in the section Why we process personal data and what authorizes us to do so. Such processors are:

D. From what sources do we obtain personal data?

We usually collect personal data directly from you through our website or when we communicate with you. We may also receive some other data from our partners, such as banks or shipping companies.

In most cases, we process personal data that you provide to us when you order goods or services, create and use an account. We also collect personal data directly from you by monitoring your behavior on our website and when you read messages.

If you make a purchase from us, we may receive additional information about your orders from banks, our partners operating payment systems, and shipping partners in connection with the fulfillment of the purchase contract, such as information about your account number, successful payment, or delivery and receipt of goods.

E. Transfer of data outside the EU

In some cases, we may also transfer your personal data to countries that are not part of the European Economic Area.

As part of the transfer of data to our processors, as set out in the section Who processes your personal data and to whom do we transfer it?, we may also transfer your data to third countries outside the European Economic Area that do not ensure an adequate level of protection for personal data. We will only carry out any such transfer if the relevant processor undertakes to comply with the standard contractual clauses issued by the European Commission and available at this address.

F. What rights do you have when processing personal data?

You have a number of rights in relation to your personal data. These include the right to access, rectify, erase, restrict processing, portability, object and lodge a complaint.

Just as we have rights and obligations when processing your personal data, you also have certain rights when processing your personal data. These rights include:

Simply put, you have the right to know what data we process about you, for what purpose, for how long, where we obtain your personal data, to whom we transfer it, who processes it outside of us and what other rights you have related to the processing of your personal data. However, if you are not sure what personal data we process about you, you can ask us to confirm whether or not personal data concerning you is being processed by us, and if so, you have the right to access this personal data. As part of the right to access, you can ask us for a copy of the personal data being processed, and we will provide you with the first copy free of charge and subsequent copies for a fee.

  • Right to correction

To err is human. If you find that the personal data we process about you is inaccurate or incomplete, you have the right to have it corrected or completed without undue delay.

  • Right to erasure

In some cases, you have the right to have your personal data erased. We will erase your personal data without undue delay if one of the following reasons applies:

  • you withdraw your consent to the processing of personal data, which is data for which your consent is necessary and we have no other reason why we need to continue to process this data;
  • you exercise your right to object to processing (see the Right to object to processing section below) for personal data that we process based on our legitimate interests and we find that we no longer have any such legitimate interests that would justify such processing, or
  • you believe that the processing of personal data carried out by us is no longer in accordance with generally binding regulations.

However, please note that even if one of these reasons applies, this does not mean that we will immediately delete all of your personal data. This right does not apply if the processing of your personal data is still necessary for compliance with our legal obligation or for the establishment, exercise or defence of our legal claims (see the section Why do we process personal data and what authorises us to do so?).

  • Right to portability

You have the right to obtain from us all your personal data that you have provided to us and that we process on the basis of your consent (see section If you give us your consent) and on the basis of the performance of a contract. We will provide you with your personal data in a structured, commonly used and machine-readable format. In order to be able to easily transfer the data at your request, this may only be data that we process automatically in our electronic databases.

  • Right to object to processing

You have the right to object to the processing of personal data based on our legitimate interest.

  • Right to file a complaint

Exercising your rights in the above manner does not affect your right to file a complaint with the relevant supervisory authority. You can exercise this right in particular if you believe that we are processing your personal data unlawfully or in violation of generally binding legal regulations. G. How can individual rights be exercised?

The fastest way to exercise and request the exercise of your right is by email. We will process your request without undue delay, but within one month at the most. In exceptional cases, especially due to the complexity of your request, we are entitled to extend this period by another two months. We will of course inform you of any such extension and its justification.
