The Buyer is obliged to familiarise themselves with the Returns Policy and General Terms and Conditions (hereinafter referred to as "GTC") before ordering goods. The Buyer also acknowledges that they are obliged to provide the Seller with the necessary cooperation for processing a claim; otherwise, the deadlines will be extended accordingly by the time the Buyer has not provided the requested cooperation.

Definitions of terms contained in this Returns Policy take precedence over definitions in the GTC. If this Returns Policy does not define a term, it shall be understood in the meaning in which it is defined in the GTC. If it is not defined there either, it shall be understood in the meaning used by the valid legal regulations of the Czech Republic.

II. Basic Provisions

As proof of warranty, the Seller issues a proof of purchase (invoice) for each purchased item with the legally required details necessary for exercising rights from defective performance (especially the name of the goods, warranty period, price, quantity).

1. Time Limit for Exercising Rights from Defective Performance

The time limit for exercising rights from defective performance begins on the day the Buyer takes over the goods, i.e., the day indicated on the proof of purchase or warranty card. This period is 24 months for new goods for a consumer Buyer.

Rights arising from liability for defects of goods for which a quality warranty applies shall expire if not exercised within the specified period.

In the case of claim resolution by exchanging goods for new ones, a new time limit for exercising rights from defective performance does not start. The time limit that began on the day the original goods were taken over by the Buyer remains decisive. The period from the claim of a justified complaint until the time the Buyer was obliged to take over the goods is not included in this period.

2. Quality Upon Receipt

The Seller is liable to the Buyer that the item has no defects upon receipt. Specifically, the Seller is liable to the Buyer that at the time the Buyer took over the item:

  • the item has the properties that the parties agreed upon, and if there is no agreement, such properties as the Seller or manufacturer described or that the Buyer expected given the nature of the goods and based on advertising carried out by them;
  • the item is suitable for the purpose for which the Seller states its use or for which an item of this kind is usually used;
  • the item is in the corresponding quantity, measure, or weight;
  • the item meets the requirements of legal regulations.

If a defect manifests itself within twelve (12) months of receipt, it is presumed that the item was defective upon receipt by the Buyer, unless the nature of the item or defect contradicts this or unless the Seller proves otherwise.

3. Contractual Quality Warranty

Beyond the statutory period (24 months), the Seller may provide free service within the indicated period. This service is governed exclusively by this Returns Policy and the conditions of free service. This free service is not the same as the paid "Extended Warranty" service, the conditions of which are governed exclusively by the terms of that specific service.

III. Warranty Conditions

1. Goods Inspection Upon Receipt

Upon personal collection from the Seller, the Buyer shall inspect the goods being collected, their completeness, and the undamaged condition of the packaging.

Upon receipt from the carrier, the Buyer shall properly and carefully inspect the condition of the shipment (especially the number of packages, integrity of the tape, integrity or damage to the packaging) according to the shipping document. The Buyer shall further inspect the completeness of the goods on the day of receipt, particularly that the package contains everything it should.

Any discrepancies must be reported to the Seller upon personal collection at the location. When receiving from the carrier, damage must be noted in the carrier's handover protocol, or the Buyer may refuse to accept a clearly damaged shipment entirely. Discrepancies can also be reported to the email address information@jimot.cz (or eshop@jimot.cz). In the case of receiving a damaged shipment from the carrier, the Seller recommends taking and attaching photographic documentation of the damage to the goods and packaging.

These agreements do not affect the statutory time limit for exercising rights from defective performance. A subsequent claim for incompleteness or external damage to the shipment does not relieve the Buyer of the right to claim the item, but it gives the Seller the opportunity to prove that there is no breach of the purchase contract.

2. Claim Submission

The Buyer can submit a claim by sending the claimed goods to the Seller's registered office address, or in person, but only by prior arrangement.

The shipment must contain: the claimed goods (including all accessories). The Seller also recommends enclosing a copy of the proof of purchase or otherwise suitably documenting the origin of the goods, a detailed description of the defect, and sufficient contact details of the Buyer (especially return address and phone number). Without the above, identification of the origin and defect of the goods may be impossible or significantly difficult.

The Seller shall issue the Buyer with written confirmation of when the claim was submitted, its content, and the method of claim resolution requested by the Buyer, immediately after receiving the claim. In the case of submitting a claim in person, the confirmation is handed over immediately in hard copy upon customer request; in all other cases, the confirmation is sent by email. The confirmation serves as proof of claim acceptance; the actual condition of the goods will be assessed within the claim procedure.

The Buyer is aware that if they do not deliver the claimed goods including all received accessories, then in the case of an approved claim and subsequent withdrawal from the contract by the Buyer, the purchase price refunded to the Buyer will be reduced by the value of the undelivered accessories.

3. Exclusions

By breaching a protective seal, informative sticker, or serial number, the Buyer runs the risk of the claim being rejected, unless the damage occurs during normal use. Seals and serial numbers are an integral part of the goods and do not in any way restrict the customer's right to use and handle the goods to the full extent for which the goods are intended.

Furthermore, rights from defective performance (warranty) do not apply to damage caused by (if such activity is not normal and is not prohibited in the enclosed user manual):

  • mechanical damage to the goods;
  • using the goods in conditions that do not correspond to their temperature, dust, humidity, chemical, and mechanical environmental influences, which are directly specified by the seller or manufacturer;
  • unprofessional handling, operation, or neglect of the goods;
  • damage caused by excessive load or use contrary to the conditions stated in the documentation or general principles;
  • carrying out an unqualified intervention or parameter change;
  • to goods that have been modified by the customer, if the defect arose as a result of this modification;
  • damage by natural elements or force majeure.

These limitations do not apply if the properties of the goods that are contrary to the above conditions were expressly agreed upon, stipulated, or declared by the Buyer and Seller, or can be expected given the advertising or usual use of the goods.

4. Claim Rejection

The Seller has the right to reject a claim for goods in cases where the claimed goods and/or their components are heavily soiled or do not meet the basic prerequisites for hygienically safe handover of goods for claim processing according to generally binding hygiene regulations.

IV. Claim Resolution

1. Buyer - Consumer

A consumer is any natural person who, outside the scope of their business activity or independent exercise of their profession, enters into a contract with an entrepreneur or acts with them.

If the Buyer is a consumer, the Seller shall decide on the claim immediately, or in complex cases within three working days. This period does not include the time reasonably required for expert assessment of the defect, depending on the type of product or service.

The claim, including the removal of the defect, must be resolved, and the consumer must be informed of its resolution no later than 30 days from the date of claim submission, unless the Seller agrees on a longer period with the consumer. After this period expires, the consumer has the right to withdraw from the contract or request a proportionate discount.

If the item has a defect, the Buyer-consumer may request its removal by repairing the item or by delivering a new item without defects, unless the chosen method of defect removal is impossible or disproportionately costly compared to the other. The Buyer-consumer may request a proportionate discount or withdraw from the contract if the Seller refuses to remove the defect, has not removed it within the statutory period, if the defect occurs repeatedly, or if the defect is a substantial breach of the contract.

2. Buyer - Entrepreneur

If the Buyer is an entrepreneur, the Seller undertakes to decide on and resolve the claim within 40 days from the date of claim submission. The Buyer-entrepreneur will be informed of this decision and the method of resolution at their contact email address.

V. Joint Provisions

The Seller shall issue the Buyer with written confirmation of the date and method of claim resolution, including confirmation of the repair performed and the duration of the claim, or a written justification for rejecting the claim.

After the claim is resolved, the Seller will notify the Buyer of the end of the claim procedure either by phone, SMS, or email. If the goods were sent by courier service, they will be automatically sent back to the Buyer's address after resolution.

After resolution of an approved claim by repair, the time limit for exercising rights from defective performance is extended by the duration of the claim. The duration of the claim is calculated from the day following its submission until the day the Buyer was informed of its resolution.

The Buyer-consumer has the right to reimbursement of reasonably incurred costs associated with exercising a justified claim. These costs are understood as the minimum necessary (especially postage for sending the claim). These costs generally do not include travel by car for personal claim submission, express shipping, and other similar above-standard costs. Reimbursement of costs must be requested without undue delay, but no later than 1 month after the expiry of the time limit for exercising rights from defective performance.

The Buyer is obliged to inspect the goods being collected and their compliance with the claim collection protocol. The Buyer shall also inspect the completeness of the goods. Subsequent objections regarding the contents of the package and the external condition of the resolved claim will not be considered. This does not affect the statutory time limit for exercising rights from defective performance in the case of hidden defects.

The Buyer is obliged to take over the claim without undue delay within 30 days from the date they were informed of its resolution. This period cannot expire earlier than 60 days from the submission of the claim.

In the event that the claim is not collected by the Buyer no later than the last day of the period, the Seller will charge storage fees for storing the goods at a rate of CZK 20 including VAT per day of delay after the futile expiry of this period.

If the Buyer does not collect the goods from the resolved claim within 6 months from the date they were informed of its resolution, the Seller reserves the right to sell the goods in a suitable manner and use the proceeds to cover the incurred storage fees.

VI. Consumables and Minimum Lifespan

If the subject of purchase is consumable material, or if such material is part of the purchased goods, the defined lifespan shall apply to it instead of the quality warranty. The lifespan may be indicated temporally, by usage time, or by the number of uses (e.g., number of printed pages, number of cycles). More than one of these lifespans may be indicated for the goods. To successfully claim, all stated conditions and manufacturer's instructions must be followed.

The Buyer's right to claim goods within the statutory 24-month period is not affected by this. However, the Buyer must take into account the above-mentioned facts, as liability for defects does not apply to wear and tear caused by normal use of the item and cannot be confused with the product's lifespan. The lifespan of the goods represents susceptibility to wear and tear caused by normal use. If the Buyer uses the goods beyond their normal lifespan, it is likely that the resulting defect is a consequence of normal wear and tear, but it is not excluded that it is actually a material or manufacturing defect (warranty defect).

The Seller is obliged to clearly indicate the lifespan for the offered goods; otherwise, they cannot invoke this specific lifespan to the detriment of statutory rights.

VII. Final Provisions

The Buyer's rights arising from the law are not affected or limited by this Returns Policy.

This Returns Policy is valid and effective from 18. 7. 2026 and fully supersedes the validity of previous returns policies.
